SECTION 16. PENALTIES.
Except as otherwise provided herein, any person shall violate any of the provisions of this Ordinance or fail to comply herewith or who shall violate or fail to comply with any order made there under, or who shall construct, reconstruct, move, demolish, alter, or change the use or bulk of a building or structure or plan and plat a subdivision in violation of this Ordinance or who shall fail to comply with the an order or decision of the Fire Inspector, Fire Chief, or Board of Review of the Fire District within the time provided for herein shall severally for each and every violation and non-compliance, respectively, be guilty of a Class B Misdemeanor, and upon conviction thereof, shall be punishable by a fine not to exceed Five Hundred Dollars ($500.00).
If the fine is not paid by the deadline imposed, the violation and failure to pay the fine or appeals in court at the set date may be further prosecuted as provided in MO Statute 321.600 Subsection (12a).
Any person, firm, or corporation having been served with an order in writing signed by the Fire Inspector, Fire Chief, or Board of Review to correct or remove any violation who shall fail to comply with such order within ten (10) days after such service or who shall continue to violate any of the provisions of this Ordinance as set forth in such order shall be guilty of a Misdemeanor and punishable as set fourth herein except that in the event of an appeal of such order, such person, firm, or corporation shall not be guilty of a Class B Misdemeanor until ten (10) days after any appeal made from such order is final.
The owner or general agent of any building, structure, or premises where a violation of the provisions of this Ordinance or order of the Fire Inspector, Fire Chief, or Board of Review has been committed or shall exist, or the lessee or tenant of any entire building or structure in which such violation has been committed or shall exist, or the owner, general agent, lessee, or tenant of any part of the building or premises in which
such violation has been committed or shall exist or the owner, general agent, architect, builder, or contractor or any other person who knowingly commits, takes part, or assists in such violation or who maintains any building or premise in which such violation shall exist, shall be guilty of a Class B Misdemeanor and punished as called for in this Section.
All violations of this Ordinance shall be referred to the prosecuting attorney for Platte County Missouri for prosecution by the office of the prosecuting attorney or the legal officer for the Fire District in his capacity as special assistant prosecuting attorney.
