1. Article 78 of the Uniform Fire Code, 1985 Edition, pertaining to fireworks shall be amended as follows:

A. Section 78.102(b) shall be amended to read as follows:

(b) It shall be lawful for any person to offer for sale, expose for sale, sell at retail, use, store, possess, or explode any Class C Common Fireworks as permitted under Chapter ' 320 of the Revised Statutes of Missouri, 1986, as amended. Such Class C Common Fireworks shall be permitted to be sold, used, and possessed during the periods of June 20 through July 10 and December 20 through January 2. Notwithstanding the provisions of the said Chapter 320, it shall be unlawful for any person to discharge any Roman Candles, rockets with sticks, winged helicopter-type devices made of more than 50% plastic and missile-type rockets ten inches or over in length from tip of nose to end of fins within any commercial subdivision and any residential subdivision containing lots smaller than 3.5 acres. It shall further be unlawful for any person to discharge into or onto any commercial subdivision or residential subdivision the above-named devices from any area outside of such subdivisions. All explosives prohibited by Chapter 320 shall also be prohibited from possession, sale, storage, use or explosion within this Fire District.

Any merchant selling Class C Common Fireworks at retail within Southern Platte Fire Protection District shall provide the Chief Fire Inspector a Certificate of Insurance showing that the merchant has during the period of permitted sale, liability insurance in the amount of at least $800,000.00, naming the District as an additional insured. No other merchant shall be permitted to sell at retail Class C Fireworks within the District. This bonding provision shall not apply to merchants within the City Limits of Parkville, Missouri, or of any other municipality with an insurance requirement.

The Chief Fire Inspector can grant permits for supervised public displays of Class B Fireworks by a jurisdiction, fair association, amusement park, service club, civic club, school club, or any other charitable or educational organization or for the use of fireworks by artisans in pursuit of their trade. At all times, the Class C Common Fireworks permitted under Chapter 320 RSMo, and by this Ordinance shall be located, discharged, and possessed so as not to be hazardous to property or to endanger any person.

2. Section 78. 103 shall be amended by the addition of the following sentence:

The bond or insurance coverage in order to be deemed adequate by the Chief shall be in the amount of at least Eight Hundred Thousand (3800,000.00) Dollars.

3. This Ordinance shall take effect and be in full force from and after the date of its third reading, passage, and approval.
